FAQ
Frequently asked questions
Is Visa Wise a law firm?
No. We specialize in technology-assisted document preparation for U.S. visa processes. We do not provide legal advice or representation. For legal questions, we recommend consulting a qualified immigration attorney.
What's the difference between EB-1A and EB-2 NIW?
EB-1A is for individuals with extraordinary ability and requires meeting at least 3 of 10 specific criteria. EB-2 NIW is for professionals with advanced degrees or exceptional ability who can show that their work benefits the national interest of the United States. Both allow you to self-petition without an employer sponsor.
What's the difference between L-1A and L-1B?
Both are intracompany transfers: a company abroad sends an employee to a related company in the United States. The L-1A is for managers and executives and allows up to 7 years. The L-1B is for employees with specialized knowledge of the company's products or processes, and allows up to 5 years. Both also serve companies opening a new office.
Do I need an employer sponsor for these visas?
Not for the green cards: EB-1A and EB-2 NIW are self-petition pathways, so you can apply without an employer sponsor or a job offer in the United States. The L-1 is different: the U.S. company files the petition for the employee it transfers.
What documents will you help me prepare?
We assist with eligibility assessments, personal statements, professional and business plans, support and recommendation letters, I-140 cover letters, I-129 support letters for L-1 petitions, and responses to Requests for Evidence (RFE) and Notices of Intent to Deny (NOID).
How do I know if I qualify?
Schedule a consultation. We analyze your profile against the criteria of each visa category and give you honest feedback on your eligibility and the strength of your case.
What happens if my petition is denied?
Our service includes support for one reapplication if your first petition is denied. We help you understand the reasons for the denial and strengthen your case for the new filing.
What is the J-1 two-year home residency requirement?
Some J-1 visa holders must return to their home country for two years before they can change to certain visa categories or apply for a green card. A waiver based on a No Objection Statement from the home country's government is one way to overcome this requirement.
